Terms and Conditions of Use and Service

1. Subject Matter and Scope

These General Terms and Conditions of Use and Service (hereinafter, "the Terms") govern access, browsing, and use of the software-as-a-service (SaaS) platform SaviaIA (hereinafter, "the Service" or "the Platform"), as well as subscriptions to its plans.

The Platform is operated under the SaviaIA commercial brand (hereinafter, "the Provider"), contact email soporte@saviaplatform.com.

Use of the Platform or subscription to any of its services confers the status of Customer or User, and implies full, express, and unreserved acceptance of every clause contained in these Terms.

2. Service Description and Channels

SaviaIA is a technological platform that builds, trains, and deploys virtual artificial intelligence assistants designed for omnichannel business customer care, using official public information and documents authorized by the Customer.

Key features of the Service include:

  • Intelligent extraction and indexing: automated parsing of the official public website and uploaded documents to create a verified knowledge base.
  • Interactive web chat: embeddable widget for the Customer’s website with 24/7 availability and real-time streaming responses.
  • WhatsApp Business: integration to handle text messages and voice notes on WhatsApp while maintaining conversational context.
  • Natural voice telephone channel: dedicated telephone number to answer incoming calls, answer questions with high-fidelity synthetic voice, and transfer to human operators when needed.
  • Lead capture and qualification: structured collection of contact data (name, email, phone, inquiry) and automated commercial interest scoring.
  • Calendar integration: real-time availability checks and direct appointment booking in external calendars (Google Calendar, Cal.com).
  • AI declaration by design: proactive compliance with Article 50 of the European AI Act, informing users across every channel that they are interacting with an automated system.

3. Registration, Account, and Credential Safeguards

To access the operations dashboard (Backoffice) and configure an assistant, the Customer must register with truthful, complete, and updated information. The Customer is solely responsible for maintaining the confidentiality of their access credentials and for all activities carried out under their account.

In the event of suspected or detected unauthorized use of the account or any security incident, the Customer must immediately notify soporte@saviaplatform.com.

4. Subscription Plans, Billing, and Payments

SaviaIA offers different subscription tiers (Essential Plan, Professional Plan, Advanced Plan, and custom Enterprise Plan), whose pricing, usage limits, and detailed features are set out on the official Pricing page (/pricing).

  • Pricing and taxes: Prices are expressed in Euros (€) and do not include legally applicable taxes (such as VAT), which are itemized during the checkout process according to the Customer’s tax residence.
  • Billing cycles and automatic renewal: Subscriptions are contracted on a monthly or annual basis and renew automatically and tacitly at the end of each period, unless canceled prior to the renewal date.
  • Secure payment gateway: Payments are processed over encrypted channels via the payment service provider Stripe. SaviaIA does not store or have direct access to full credit or debit card numbers.
  • No setup fee or lock-in: Unless expressly agreed in custom enterprise agreements, no initial setup fees apply and the Customer may cancel at any time from their panel without financial penalties.

5. Customer Obligations and Acceptable Use

The Customer expressly agrees to:

  • Provide only information, URLs, and documents for which they hold legitimate rights of use and dissemination, warranting that content does not infringe third-party intellectual property rights or applicable law.
  • Not use the assistant for unlawful, deceptive, fraudulent, spam, harassment, malware distribution, or public order-violating purposes.
  • Comply with applicable consumer protection and e-commerce regulations regarding commercial terms and pricing communicated by the assistant to end users.
  • Properly inform end users in their own privacy policy regarding the data processing carried out through the assistant deployed across their channels.

6. Service Level, Availability, and Maintenance

The Provider employs its best technical and organizational efforts to ensure continuous, high-quality availability of the Service. However, the service may experience brief interruptions due to scheduled maintenance, security updates, or unforeseen network contingencies.

Maintenance windows likely to noticeably affect operations will be scheduled preferentially during low-demand periods and announced with reasonable advance notice.

7. Intellectual and Industrial Property

The Provider is the exclusive owner of all intellectual and industrial property rights over the Platform, its source code, technical architecture, algorithms, graphic interfaces, trademarks, logos, and associated documentation.

The Customer retains at all times exclusive ownership over their own data, trademarks, logos, and supplied content. SaviaIA receives solely a limited, revocable, and non-exclusive license to process such content for the strict purpose of performing the subscribed Service.

8. Liability and Limitation of Warranty

SaviaIA implements an architecture based on validated facts (strict grounding) designed so that the assistant responds solely on the basis of materials provided by the Customer and transparently declares a lack of information when a query exceeds that corpus.

To the maximum extent permitted by applicable law, the Provider’s total aggregate liability to the Customer for any cause arising from or in connection with these Terms shall be limited to the total amount actually paid by the Customer in the twelve (12) months immediately preceding the event giving rise to liability.

9. Cancellation of Service and Data Portability

The Customer may cancel their subscription at any time via the dashboard or by written notification to soporte@saviaplatform.com. The cancellation will take effect at the end of the current billing cycle.

Prior to effective cancellation, the Customer may export the full history of conversations, contacts, and recorded metrics. Following permanent deletion of the assistant, all linked data will be securely and irreversibly erased, except for records that must be retained under statutory legal obligations as set out in the Privacy Policy.

10. Amendments and Governing Law

The Provider reserves the right to modify these Terms. Any material change will be communicated to the Customer with at least thirty (30) calendar days’ advance notice.

These Terms are governed by Spanish law. For the resolution of any dispute arising hereunder, the parties submit to the Courts and Tribunals of Gandía (Valencia), Spain, unless mandatory statutory rules — in particular consumer protection laws — establish a different jurisdiction.
